What Can an Elderly Parent Do to Prevent Adult Children from Taking Control of Their Lives and Assets?

Start legal planning now! This includes making plans for health care and long-term care, making plans for finances and property, naming another person to make decisions on behalf of an ill parent or one facing Alzheimer’s.

It is important for everyone to plan for the future especially for a person with Alzheimer’s. The sooner this begins the more the person with dementia may be able to participate. Early planning allows the person with dementia, possibly exhibiting memory problems to be involved and express his or her wishes for future care and decisions. This eliminates guesswork for families and lets the person with dementia to designate decision makers on his or her behalf. Early planning also allows time to work through the complex legal and financial issues that are involved in long-term care.

Two important Steps!
1. The aging parent should meet with an estate planning attorney to review any old existing documents or set up a new relevant plan.

2. Utilize documents such as a trust, power of attorney, health care directive and will to your advantage. Consider protecting the home from a future Medi-Cal lien which could wipe out a family or be financially devastating. An attorney can guide the family to protect their home and savings.

Estate planning attorney Alice Salvo achieved Super Lawyer status as published in Los Angeles Magazine. She served as the President of the Southern California Council of Elder Law Attorneys and also President of the San Fernando Valley Estate Planning Council.

The firm has answers, and a proven record of success helping families avoid expensive probate, minimize taxes, improving aid for those with special needs and benefitting elderly parents facing deteriorating health from aging.
